Lawsuit Filed by Pastel Cartel Against FDA’s Esco Bars Decision

According to a report by Vaporvoice, Pastel Cartel, the manufacturer of Esco Bars, has filed a lawsuit in the federal district court of western Texas in the United States.

According to court records, this dispute arose from the US Food and Drug Administration’s (FDA) rejection of Esco Bars’ tobacco products’ pre-market application (PMTA).

In the lawsuit, Pastel Cartel accuses the FDA of refusing its PMTA due to technical reasons and behaving negligently and carelessly.

A temporary injunction has been implemented to suspend the RTA directive until the case is resolved. The ruling states that the RTA violated the Administrative Procedure Act (APA) and the due process clause of the Fifth Amendment of the US Constitution. The final decision revokes the RTA directive and returns the PMTA case to the FDA for further review.

According to a statement from the FDA, earlier the manufacturer of Esco Bars products and the distributor of Breeze products, Breeze Smoke, LLC, have also received warning letters for manufacturing, distributing, and/or importing unauthorized tobacco products in the United States.
