The Philippines Tightens Regulations on E-Cigarette Products

The Department of Trade and Industry (DTI) in the Philippines is set to release new supplementary guidelines next month for the mandatory certification of e-cigarette products. This move is part of the Philippines’ efforts to ensure that all manufactured or imported e-cigarette products comply with national quality and safety standards before they hit the market.

Transition Period for Compliance

Starting in June this year, and extending until January 2025, there will be a transition period during which retailers can clear out existing non-compliant e-cigarette stock. After this period, only certified compliant e-cigarettes will be allowed for sale. This phased approach aims to give businesses ample time to adjust to the new regulations without immediate disruption.

Certification Marks: PS and ICC

Under the Republic Act 11900, also known as the E-Cigarette Law, the mandatory registration and certification of e-cigarette products will require them to carry the Philippine Standard (PS) mark or the Import Commodity Clearance (ICC) label. These marks are proof that the products meet the DTI’s standards for quality and safety.

  • PS Mark: Indicates compliance with national quality standards.
  • ICC Label: Required for all imported goods to ensure they meet safety regulations.

Public Consultation and Future Guidelines

Assistant Trade Secretary Amanda Nograles highlighted that public consultations had been held to gather feedback on the draft of the supplementary guidelines. “We have gathered public input and will finalize and release the supplementary guidelines next month,” Nograles stated.

The upcoming memorandum circular will detail these guidelines, building upon the earlier Department Administrative Order 22-06, which laid down the certification requirements for vapor products containing nicotine and non-nicotine.

Testing and Certification Facilities

The DTI has a testing laboratory in Calamian where rechargeable batteries, battery chargers, e-cigarette devices, and heated tobacco products are tested. However, due to the lack of facilities to test consumables, Nograles mentioned that certification could be conducted by accredited third-party laboratories.

Customs and Import Regulation

Furthermore, the DTI has communicated to the customs authorities that starting from February, e-cigarette products without a conditional release certificate from the DTI will not be allowed clearance. This certificate allows imported products to be transported to the importer’s warehouse, where they are inspected by the DTI to ensure compliance with product descriptions and packaging requirements.
