India: Shops in Karnataka Must Obtain Licences to Sell Tobacco Products

The license applications should be submitted to the Commissioner or Chief Officer of the jurisdictional municipal corporation in the stipulated form, along with a fee of ₹500licence, and the licence granted under the bylaw must be renewed after five years.

The draft bylaws of Karnataka Municipalities (Regulation and inspection of places used for sale of cigarettes and other tobacco products) seek to ban the sales of cigarettes and other tobacco products from retailers which do not obtain a license to do so.

This requirement shall apply to all the municipal corporations, including Bruhat Bengaluru Mahanagara Palike, and the Department of Urban Development has issued a notification on the draft bylaws last December.

Licensing can be done via the jurisdictional municipal corporations, and the license applications should be submitted to the Commissioner or Chief Officer of the jurisdictional municipal corporation in the stipulated form, along with a fee of ₹500. The licence granted under the bylaw must be renewed after five years and the application for licence renewal has to be made one month prior to the licence expiry.

Licenses must be displayed in shops

These licenses will be an official requirement after three months from the date of their final publication in the official gazette, and must be displayed in visible spaces in all retail stores selling the products. Anyone who is negatively impacted by these bylaws may appeal within 15 days of the receipt of such an order to the Assistant Commissioner of the sub-division, yet any breach of the provision of these bylaws will be punishable with a fine.
