Smoore International Receives Temporary Approval for Marketing Denial Order

On October 16th, Smoore International (06969.HK), a listed company on the Hong Kong Stock Exchange, announced that the U.S. Food and Drug Administration (FDA) has issued a Marketing Denial Order (MDO) to R.J. Reynolds Vapor Company (RJR) regarding six flavors of their Vuse Alto brand e-cigarette products, including mint and mixed berry flavors. Smoore International has been notified by RJR that the temporary administrative stay of the Marketing Denial Order (MDO) has been approved, allowing the marketing and distribution of mint-flavored products to continue in the United States.

Smoore has announced that its board of directors has taken notice of the Marketing Denial Order (MDO) issued by the FDA to R.J. Reynolds Vapor Company (RJR) on October 12, 2023. This order pertains to six e-cigarette products under RJR’s Vuse Alto brand, specifically the mint and mixed berry flavors. The company supplies mint-flavored products to RJR, which accounted for approximately 13% of the group’s revenue between January 1, 2022, and September 30, 2023.

Smoore has announced that the board has taken note of RJR’s intention to question MDOs and seek a temporary stay of execution. The company has also been informed by RJR that the temporary administrative stay for MDOs has been approved, allowing the marketing and distribution of mint-flavored products to continue in the United States. If the temporary stay is granted, mint-flavored products will be able to continue to be marketed and distributed in the United States. However, if RJR fails to obtain the temporary stay and the temporary administrative stay expires or is revoked, or if the MDOs are ultimately upheld, mint-flavored products may not be allowed to be marketed and distributed in the United States.

Smoore has stated that the company will closely monitor the situation and provide further updates as necessary.
