In New Zealand, a significant oversight in government regulation is putting thousands of e-liquid retailers in a challenging position, potentially operating outside the bounds of the law. This issue stems from the lack of government focus on enforcing existing regulations, putting the spotlight on a pressing need for regulatory adjustments in the e-liquid market.

Letitia Harding, CEO of the Asthma and Respiratory Foundation NZ, voiced concerns over the minimal government intervention in enforcing laws among e-liquid retailers. This concern arises amidst the backdrop of unfortunate but unsurprising layoffs within the Health Ministry, pointing to a broader issue of misplaced government priorities.

A revealing survey last year showed the Department of Health’s e-liquid Regulatory Authority (VRA) operates with limited manpower — a stark reflection of the regulatory body’s inadequacy in managing compliance across the board. With only a handful of employees tasked with overseeing thousands of retailers, the scope of this issue becomes glaringly apparent.

During a visit to an e-liquid retailer, the Foundation identified numerous non-compliant products, further emphasizing the widespread nature of this problem. Despite the growing number of specialist e-liquid retailers, now exceeding 1,530, there’s a clear gap in governmental commitment to enforcing compliance, leaving the industry in a regulatory grey area.

Harding suggests a shift in responsibility to the Department of Legal Affairs, proposing a model akin to alcohol sales regulation, could offer a solution. This change would ensure rigorous product inspections and adherence to safety standards, potentially curbing the rise in e-cigarette addiction among the youth.

An investigation initiated by the e-liquid regulatory authority into a company operating two non-compliant websites highlights the sporadic enforcement actions taken so far. Despite these efforts, no fines have been issued, raising questions about the effectiveness of current regulatory measures.

This situation calls for a critical reevaluation of New Zealand’s approach to e-liquid regulation. Without decisive action and a reallocation of resources towards enforcement, thousands of retailers will continue to operate in a legal limbo, with potential health implications for the wider community.
