The regulations clarified that manufacture, OEM, and brand-hold vapes including pods, kits, and products sold in combination with pods and kits, as well as enterprises manufacturing items with nicotine in China need to apply for a tobacco monopoly production enterprise license.
The license scope of manufacturing enterprise licenses is classified into three categories: manufacturing enterprise licenses (electronic cigarette products including vapes and heat not burn devices), manufacturing enterprise licenses (vapes), production enterprise licenses (nicotine for electronic cigarettes), including:
(1) Production enterprise license (electronic cigarette products).
1. Pod production (domestic sales/export); pod processing; pod brand ownership (domestic sales/export).
2. Production of kits (domestic sales/export); OEM processing of kits; brand ownership of kits (domestic sales/export).
3. Production of products sold in combination with pods and kits (domestic sales/exports); OEM processing of those pods and kits; brand ownership of products sold in combination with pods and kits (domestic sales/exports).
(2) Production enterprise license (aerosols).
Atomizer production (domestic/export).
(3) Production enterprise license (nicotine for electronic cigarettes).
Production of nicotine for e-cigarettes (domestic/export).
Note: Whether it is a domestic sales-oriented production enterprise or an export-oriented production enterprise, all e-cigarette-related enterprises engaged in the production, OEM, and brand ownership of e-cigarette products in China, as well as the production of atomizers and nicotine for e-cigarettes, must apply for tobacco products in accordance with the law.
