Urgent Call for Fairness: The UK’s Tobacco and Vapes Bill Faces Scrutiny

The UK’s Tobacco and Vapes Bill, announced in the King’s speech on November 7th, 2023, and introduced to Parliament on March 20th, 2024, aims to regulate the sales and marketing of tobacco and vaping products. Its primary focus is preventing youth access to vaping by increasing enforcement against illegal sales and potentially banning disposable vapes.

Misinformation Clouds the Debate

A recent committee on the bill has faced criticism for its selection of stakeholders, which was biased towards those supporting the measure. This “Chamber of Misinformation” has not included representatives from the vaping industry or the millions of vapers, nor any MPs who oppose the bill. This one-sided presentation during the hearings on April 30 and May 1 has raised concerns about the fairness and accuracy of the evidence influencing the bill’s legislative process.

John Dunne, Director General of UKVIA, has highlighted several key points:

  • Research by ASH shows a significant increase in the perception among 11-17 year olds that vaping is as harmful, if not more so, than smoking.
  • This misconception has coincided with a doubling of smoking rates among children.
  • Half of adults also wrongly believe vaping is as harmful as smoking, which could deter them from quitting smoking.

The Political vs. Public Health

The government‘s handling of the bill has been criticized for prioritizing political gain over public health. Dunne argues that while stricter enforcement against youth vaping is necessary, the government’s approach might actually increase black market activity and deter adult smokers from quitting. He suggests that the government should instead invest more in Trading Standards and consider licensing vape retailers to control illegal sales better.

The UKVIA has recently addressed the quality and accuracy of information presented to the Tobacco and Vapes Bill Committee in letters to local MPs. They emphasized that:

  • The oral evidence was often misleading, incomplete, or incorrect.
  • Excluding representatives from the vaping industry led to a skewed message.
