A tax rate of 36% on the production or import of vapes and an 11% tax on the wholesale distribution of the products has been announced.
The Chinese industry had operated within a grey area for years, then in the last couple of years a movement towards regulating started. As part of this trend, the Ministry of Finance has just announced a tax rate of 36% on the production or import of vapes and an 11% tax on the wholesale distribution of the products.
Meanwhile, a new bill which went into effect earlier this year, will ban 122 vape flavours as proposed by the State Tobacco Monopoly Administration (STMA), including numerous fruit and alcohol flavours. The new measure also amends the country’s tobacco monopoly, extending it to e-cigarettes, which forces local businesses to register with the tobacco authority.
Moreover local manufacturers must now obtain an additional licence to prove they are in possession of sufficient funds for production, and an adequate facility and equipment that meet the set standards. Subsequently the STMA has just published a guidance outlining the process for Chinese e-cigarette manufacturers to obtain the required manufacturer licence.
Chinese brands are suffering due to imminent restrictions
As a result of the direction that China is taking, shares in Chinese consumer brands have suffered. In fact, last year a Relx shareholder filed a lawsuit in the US against the Chinese e-cig manufacturer, accusing the company of not taking into account imminent Chinese regulations when applying for the US initial public offering (IPO) in October 2020.
The class action lawsuit was initiated in the US District Court for the Southern District of New York, by Investor Alex Garnett, who bought 300 shares at $27.87. He said that he and other investors “sustained substantial damages in connection with their purchases of shares” in RLX Technology, which is one of the biggest manufacturers, distributors and sellers of vaping products in China
According to an article by ECigIntelligence, Garnett accused RLX of not taking into account the aim of Chinese regulators to tighten the regulations governing vaping products in the country, in their registration statement for the IPO. “RLX’s discussions of risk factors did not even mention, much less adequately describe the risk posed by, China’s ongoing effort to establish a national standard for e-cigarettes that would bring them into line with ordinary cigarette regulations,” reads the complaint, which calls for a jury trial.
Perhaps you are aware that the Philippines vaping community recently witnessed a dynamic shift that will, beyond doubt, impact people’s lives as we advance. Yes, a major law was passed to regulate the use and other related activities of e-cigarettes as well as heated tobacco products in the country. Therefore, several questions may come to mind. For instance, how important is this law? How did the bill fare at the Philippines senate? And how does its enactment affect vapers? This article provides insight into these. But first, what is this law about?
Vaporized Nicotine and Non-Nicotine Products Regulation Act
The Vape Regulation Act, also known as the Vaporized Nicotine and Non-Nicotine Products Regulations Act, was a harmonized bill ratified by the Philippines House of Representatives and Senate at the beginning of this year, January 26th.
And as mentioned earlier, it was designed to regulate the importation, production, sale, branding and packaging, distribution, as well as the use and consumption of anything vape, including e-cigarettes and heated tobacco products (HTPs). The law aims at using global standards to protect Filipinos from the hazards of regulated, unregulated, and substandard products. Again, you should note that the law is a worthy improvement to House Bill 9007 or the ‘Non-Combustible Nicotine Delivery Systems Regulation Act.
How Did the Vape Regulation Bill Become a Law?
So, how did the bill fare at the Philippines senate? Pretty well, actually. It was so widely received that the votes eventually hitched at 19 to 2 in favor of the bill. However, when it was introduced to the Senate in late 2021, it was met with diverse reactions from different groups. And its provisions also sparked debates within the vaping community, as featured by several media outlets. While the debates ensued, several lobbying attempts were made by both the pro- and anti- groups to the bill.
During the presidential assent stage, which began on June 24th, 2022, then-President Rodrigo Duterte was met with a lot of pressure. Several stories flew around about efforts to lobby Duterte as well as the new President to veto the bill. You may know that the Philippines legal landscape allows the President a 30-day limit to sign a bill into law. However, neither of the presidents made a move on the bill.
As a result of this inaction, the bill finally lapsed into law on July 25th.
How Philippines Citizens React to E-Cigarettes
An Asian Research Institute conducted a survey in the Philippines. And it was found that 90% of local smokers (i.e., 9 out of 10) support a healthier nicotine consumption plan. Hence, available alternatives to direct cigarette inhalation, such as e-cigarettes, were declared a better option to opt for. And if a public health strategy makes these alternatives available, they are open to it. Thus, they are receptive to e-cigarettes and vapes.
In the same vein, more comprehensive research conducted by ACORN Marketing & Research Consultants and commissioned by Consumer Advocacy Group Vapers PH reveals that the public calls for a decrease in tobacco harm.
This is one of the many reasons the bill was introduced. And thankfully, it has been enacted. Thus, these products are now allowed in the country with detailed regulations on their manufacturing, distribution, and consumption. According to ACORN, “Majority have a positive perception, would consider switching to e-cigarettes and heated tobacco products, and would like to have greater access to accurate information about these products.“
Here are a few facts about the new law:
The law gives room for the sales of vaping products with nicotine strengths of up to 65 mg/mL (6.5 percent).
The legal age of product purchases has been lowered from 21 to 18. Thus, more people would take on vaping in the country. However, minors are restricted.
The law introduces restrictions and sanctions on stores and online vendors that sell vaping products.
The new vape law disallows the promotion of vape products. This is especially true with social media brand ambassadors and influencers boosting vape brand sales.
There is atransfer of authority over vaping and heated tobacco products from the Philippines Food and Drug Administration (FDA) to the Department of Trade and Industry (DTI). So, the DTI will create product standards and rules for sellers.
How Will the Philippines Law Affect Nicotine Consumers?
Did you know that over 16 million Philippines citizens smoke? The new law helps to reduce the negative health impacts of smoking by offering vaping as a suitable option. With this enacted bill, e-cigarettes are now products approved and regulated by the government. And this healthier alternative undoubtedly has the potential to save millions of lives.
One of the notable icons who sponsored the bill in the House of Representatives is former House Deputy Speaker Rodante Marcoleta. And here are a few words he has to say as regards the impact of the bill on the overall health of Filipino people, “It is a gift to the Filipino people towards better health and well-being.”
The former House Deputy speaker further opined, “With this law, we have a very good chance to eradicate the smoking epidemic, which kills almost 100,000 Filipino smokers every year, once and for all. It will be just a matter of time before we see our country’s smoking rate go down.“ And interestingly, the government has set up parastatals to execute this positive health change among the Filipinos. The bill instructs the Department of Trade and Industry, as well as the Food and Drug Administration, to cater to this. They will be responsible for setting up a quality standard for vape products.
Further, they are tasked with ensuring safe and consistent vape products. And in the same vein, the Department of Health is asked to set workable guidelines and strategies for awareness campaigns. These campaigns are largely focused on smoking and vaping restrictions. Examples include that no one below 18 can purchase, sell or use any vaping or e-cigarette product. Hence, the bill asks the DoH to put up structures for the executions of these sensitization drives.
Heading in the Right Direction
Most legal tussles as regards vape law across the globe can be seen as misguided debates. Many countries should take a cue from the Philippines with this new law. Rather than fight vaping, why not create a sustainable legal structure that will ensure a healthier use of nicotine? The Philippines have found a laudable and innovative way to create smart vaping guidelines. Now, other countries should do the same.
Research into e-cigarettes is dominated by American scientists and a few names emerge as clear leaders in the field, despite the involvement of thousands of scholars over the last decade.
Those are among the lessons taught by an intriguing new analysis of published research which sought, among other things, to identify where it comes from, who authors it, and who publishes it. The study, “Mapping of global research on electronic cigarettes: a bibliometric analysis”, has been published in the journal Frontiers in Public Health and was conducted by Xuechao Li of Shaanxi University of Chinese Medicine, Xianyang, along with several co-authors.
It found that between the years 2000 and 2021 there were just under 8,000 published items of scientific research covering e-cigarettes, with 20,000 authors, although unsurprisingly they were overwhelmingly post-2014.
The US dominates by producing nearly 60% of that work, followed distantly by the UK (10%) and then Canada and Australia. The most productive institution was the University of California San Francisco, with King’s College London and the University of Waterloo in Canada being the only non-US institutions in the top ten – although UK journals actually published the most (nominally UK journals, at least; it’s not like they’re intensely parochial).
Top authors
Nicotine & Tobacco Research was not only the journal with the most published papers but also the most cited one.
And what have they all been studying? “The main research domains in this field were the prevalence, awareness, reasons for using e-cigarettes; e-cigarettes use for tobacco harm reduction; exposure in the population; and the relationship between e-cigarettes and tobacco and nicotine,” said the researchers, while the most commonly used keywords were “electronic cigarettes, smoking, tobacco, nicotine, smoking cessation, the United States, and…” – of course – “adolescents”.

Titled ‘The Subversion of Public Health: Consumer Perspectives’, a white paper presented at the recent Fifth Asia Harm Reduction Forum (AHRF 2022) has now been publicly released.
Compiled by several leading international Tobacco Harm Reduction (THR) experts, it was presented at the 28 October forum in the Philippines by Nancy Loucas, Executive Coordinator of CAPHRA (Coalition of Asia Pacific Tobacco Harm Reduction Advocates).
It follows the authors reviewing information from the World Health Organization (WHO) on their approach and guidance for safer nicotine products (SNP), specifically on e-cigarettes.
The paper then aims to provide information and evidence that has not been included in any of the guidance publicly provided by the WHO to signatories and delegates of the Framework Convention on Tobacco Control (FCTC) on safer nicotine products (SNP).
In her presentation, Ms Loucas says, “public health is ‘the science and art of promoting health, preventing disease and prolonging life through the organised efforts of society.’ But asks, ‘what happens when citizens and policymakers are not given the full information to make informed choices about their health?’”
Consumer advocates strongly believe that the global tobacco control community has failed miserably in their rejection of THR. Ms Loucas says advocates are not about the money, glory or attention, but about saving lives, their own and those of the people they care about.
Her presentation asks: ‘How is it that harm reduction is embraced and celebrated in every other aspect of public health, except when it comes to tobacco?’
“The disinformation offered by WHO FCTC and its affiliates to signatory countries as ‘guidance’ is dangerous. The FCTC has failed, and continues to fail, the eight million adults who die from unsafe tobacco products annually,” says Ms Loucas.
At AHRF 2022, key global vaping advocates signed ‘The Manila Declaration’. It calls for an independent review of the WHO’s scientific and policy analysis, challenges its decision-making, and demands the WHO leadership launches a comprehensive rethink.
“We need to see some sign that the WHO is embracing innovation, not squandering the opportunity to make a real difference to the global burden of cancer, heart disease and crippling lung conditions,” says Ms Loucas.
Advocates believe the FCTC is no longer fit for purpose. Instead, it has been subverted to benefit a few, at the expense of the whole.
“Let’s get back to basics and let’s see some inclusiveness. Let’s see an acknowledgement of scientific innovation, consumer knowledge and experience, to help people, not disenfranchisement or discrimination,” says Nancy Loucas.

What’s the Difference between Disposable and Refillable Vapes?
The alternative to disposable vapes is a refillable or rechargeable vape. The difference between the two is that disposable vapes are single use, and refillable vapes are a device you top up to use and reuse.
Reusable vape devices are a more heavy-duty piece of kit to allow for the charging point and the replaceable parts. Vapers buy and replace the e-liquid when it runs out, so the main vaping device stays the same, but the juice is interchangeable. This means you can smoke multiple flavors within one device.

First and foremost, vapes are considered a helpful tool for anyone quitting smoking. Because of how disposable vapes work, they can be much smaller than their refillable counterparts. This makes them convenient to carry around in pockets or handbags. They’re also much more comfortable to hold in the hand and the mouthfeel is effortless.
Disposable vapes don’t require so much technology within the device, so individual vapes are more affordable. Lots of vapers choose disposable vapes because they enjoy the variety that comes with alternating devices. Vapers can play around with different sizes and styles and experiment with flavors without having to commit to a larger, more expensive device.
It can be hard to be in a minority (or seeming minority), with no apparent way of persuading others to your point of view. Imagine being a gun control proponent at a Trump rally, or the one supporter of abortion rights among an evangelical congregation. A socialist in the British Labour Party. Or a harm reduction advocate in a country where smoking is rife and e-cigarettes are banned.
What all such embattled idealists would do well to remember is that what seems permanent and inevitable may not be so. To paraphrase the great Ursula Le Guin, the divine right of kings once seemed an inescapable basis for government.
The present right-wing, Hindu nationalist, government of India – led since 2014 by hard-line prime minister Narendra Modi – must sometimes seem inescapable to its opponents. Such as Jagannath Sarangapani of the Association of Vapers India (AVI) and the International Network of Nicotine Consumer Organizations (INNCO).
As Sarangapani, a Hyderabad-based businessman, told British journalist Kiran Sidhu for an interesting recent article in the campaigning magazine Filter *: “The day I received [my first] vape was the day I stopped smoking: I went from smoking 40 cigarettes to zero cigarettes. Since vaping, I am so much healthier. I can taste my food better, and I no longer eat so much salt. I don’t have to take the blood pressure tablets I used to take, and I can run five kilometres.”
Just by saying this publicly, though, Sarangapani risks punishment in a country which in 2019 summarily bannedall forms of production, storage, import, export, sale, transport, distribution and advertising of e-cigarettes. Finance minister Nirmala Sitharaman even remarked at the time that it was “unfortunate” that e-cigs had been promoted as a tool for quitting smoking.
What price life insurance?
Unfortunate, you might ask, for whom? Among others, no doubt for the Indian Tobacco Company (ITC), the country’s leading cigarette manufacturer, shares in which are held by two government-owned insurance firms. As Sarangapani asks: “Can you believe a life insurance company owns a stake in a cigarette company?”
And would you believe that the national e-cig ban was instantly followed by a sharp rise in ITC’s stock price? “It can lead you to infer,” Sarangapani continues, “that the ban was pushed by tobacco companies who felt threatened.”
It’s also worth noting that, while Sarangapani says cigarette smokers are “a small percentage” of the population, India – the world’s second largest country by population – is also the eighth largest cigarette market. Add the much larger percentage who smoke bidis or chew gutka, and India is second only to China as a market for tobacco – and therefore a potentially huge e-cigarette market. The stakes here are high.

Disposable vape pens are well-loved by adult vapers for their simple and easy-to-use format. Prefilled, pre-charged and ready to vape straight from the packet, disposable e-cigarettes are convenient and effective at supporting vapers make the switch to a less harmful alternative.
Recently, however, the vaping world has been inundated with news of vape stores selling illicit, super-strength vape products. And, thanks to the popularity of these products on social media platforms, there are concerns about these products making their way into the possession of hundreds of underage vapers.
A handful of super-strength e-cigs from Geek Bar and Elf Bar have been found on the shelves of numerous UK vape shops and online stores. While the majority of Geek Bars and Elf Bars are compliant with UK legislation, there appear to be a selection of products intended for an international market that have made their way into unsuspecting vape stores.
One such product, the Geek Bar Pro, contains 4.5ml of e-liquid and 50mg of nicotine – more than double the legal limit. Because of its high strength, many vapers have reported side effects such as vomiting, coughing up blood, nose bleeds and severe throat pain.
WHY ARE THESE PRODUCTS NON-COMPLIANT?
In the UK, vape products must comply to legislation set by the Medicines and Healthcare Products Regulatory Agency (MHRA). Under the Tobacco and Related Products Regulation (TRPR) of 2016, all e-cigarettes be restricted to a maximum capacity of 2ml and e-liquids should have a maximum nicotine strength of 20mg. Like cigarettes, the sale of vape products is prohibited to children under the age of 18.
Products like the Geek Bar Pro that contain more than 2ml e-liquid with a nicotine strength of more than 20mg do not comply with UK regulations and should not be sold within England, Ireland, Scotland or Wales.
WHAT’S THE DEAL WITH TEENAGERS VAPING?
According to vaping regulations, vape products should only be sold to those aged 18 and older. As many vape products contain nicotine, there are worries about the harm that may be caused.
Vapers can also exercise caution and vigilance when buying disposable products. When trying a new disposable vape pen, always check the e-liquid capacity and the nicotine strength of each product before buying. This information should be clearly displayed on the outer packaging The product should also come with an information leaflet and a nicotine warning displayed clearly on the outer packaging.
SO, ARE DISPOSABLE E-CIGARETTES UNSAFE?
There are many reasons that vapers choose to vape with a disposable e-cig. And, when using an MHRA-compliant vape, vaping is thought to be up to 95% less harmful than smoking cigarettes.
However, “safety” is a relative term, especially when it comes to vaping. Most e-liquids and disposables contain nicotine – a highly addictive substance. That’s why disposable vape pens are only compliant when sold to adult vapers over the age of 18 and containing up to 2ml of e-liquid at a maximum nicotine strength of 20mg.
WHY ARE DISPOSABLES SO POPULAR?
Convenience
Disposable e-cigs are pre-filled, pre-charged and ready to vape straight from the packaging. They are also small and lightweight, making them simple to vape on the go. Since they are disposable, they do not require refilling with e-liquids, nor do they need recharging when the battery is depleted. Vapers can simply dispose of and replace.
Cost-effective
Smoking is an expensive habit that costs the average vaper around £2,000 a year. In contrast, vaping is much cheaper. With disposable vape pens starting from as little as £3.99 for the equivalent of up to 20 cigarettes, adult smokers can cut the costs by more than half.

Another day, another judgement in the saga of the US vapour industry’s cases against the Food and Drug Administration (FDA) over its handling of the premarket tobacco product application (PMTA) process, and this time it’s the court’s decision in the case of Bidi Vapor, Diamond Vapor, Johnny Copper, Vapor Unlimited, Union Street Brands, and Pop Vapor against the agency.
While no more conclusive for the industry as a whole than any of the other judgements in similar cases – which have certainly not all reached the same conclusions – it’s worthy of note for the spotlight it puts on the FDA’s approach to applications. In particular, it highlights the reasoning that led the agency to give companies’ marketing plans short shrift; and more generally, the way that the current controversies centre on process, not the actual pros and cons of novel tobacco products.
Particular attention has been given to the colourful language of the dissent by judge Robin Stacie Rosenbaum, which begins with a “spoiler alert” and later references Star Trek’s Borg in concluding that remand to the FDA (return of the applications for reevaluation) “is futile”. But even if chatty, it is cogently argued, and can be paraphrased thus:
Flavoured cartridge products lead kids to smoking, and are not particularly helpful for adult cessation; therefore they can only be tolerated if youth access can be prevented. However, retail controls don’t work; the applicants’ “marketing and sales-access-restriction plans, in the real world, could never be enough”. Therefore, the only option is to keep these products off the market altogether, and “remand is futile” because this underlying logic will not change even if the FDA does give closer consideration to the marketing plans. It is bound to reach exactly the same conclusion, and its failure to review marketing proposals first time round is in effect no more than a harmless error.
There is, to be sure, one gaping hole in Rosenbaum’s reasoning. How can the FDA (or the judge) be sure that no retail or marketing controls would ever work in cutting off youth access? Just because they haven’t so far does not mean that they never will (what about an unbreakable biometric link between device and purchaser, for example?). We, are after all, dealing here with reviews of innovation…
Where the judges differ
This is a key point where the majority and the dissent differ, and where chief judge William Pryor (writing the majority opinion) pointedly observed: “This excuse is akin to a federal district court judge refusing to hear a convicted criminal defendant at sentencing about his reformation plans or the impact on his family because, in the judge’s experience, he found that those things do not matter.”
The bottom line, for the majority, is just as unambiguous as it is for Rosenbaum…but from the opposite perspective. Agency action must be based “on a consideration of the relevant factors”, yet “the Administration failed to consider the relevant marketing and sales-access-restrictions plans”; therefore, “the marketing denial orders were arbitrary and capricious”.
To understand why this supposed capriciousness came about, we need to look at the history of the PMTA process from the FDA’s point of view. As described by the court, “the Administration repeatedly represented to tobacco companies that marketing and sales-access-restriction plans were relevant to its determination of whether their products were ‘appropriate for the protection of the public health’ ”.
But after saying this, and faced with a huge volume of PMTA applications, the agency then adopted its “fatal flaw” approach, which in essence led to it automatically rejecting any applications that did not include a randomised controlled trial or a longitudinal cohort study showing benefits to adult smokers.
“For the sake of efficiency, the evaluation of the marketing plans in applications” would not take place unless an application had already passed over the first “fatal flaw” hurdle, the FDA decided. It also cited similar reasoning to Rosenbaum’s: such plans probably wouldn’t make much difference anyway.
So, although of course it wasn’t phrased this bluntly, the only way an application could compensate for an unavoidable risk of youth uptake was to demonstrate benefits to adults. Fail to do that, and the rest of your application is irrelevant.
What’s it all about?
What can we learn from all this? Most importantly, perhaps, that the current arguments are all about procedure. The court noted – as others have – that it wasn’t sitting in judgement on whether the products should have been granted PMTAs, or whether the marketing plans were credible (“the Administration is not required to decide…that this evidence tilts the scales”).
The only question was whether the FDA, when it sat in judgement, did so properly. And indeed, this (rather than anything to do with public health as such) has consistently been the question raised by plaintiffs too.
Given that the issue at hand in these cases is procedure rather than science, it’s more than likely that both the review of the agency’s tobacco regulatory activities ordered by FDA commissioner Robert Califf earlier this summer and the arrival of a new head for the Center for Tobacco Products (CTP), Brian King, will bring about changes.
Any alterations to the PMTA process are likely to make it more bullet-proof from the agency’s point of view, which does not necessarily mean more explicit; it could mean the opposite.
So the future fate of heated tobacco, pouches and other products with the FDA will also almost certainly be affected by the agency’s experiences during the e-cig PMTA fiasco. And any lingering naive faith that “obvious” public health benefits will win the day through sheer persuasiveness should be abandoned.
Equally, these cases do nothing to resolve the underlying question of whether novel nicotine products are, in the terminology of the FDA and the Tobacco Control Act, “appropriate for the protection of the public health”.
That issue hasn’t come to court yet, and while judgements like that in the Bidi case might provide some temporary relief – if not closure – for the companies concerned, the fundamental rift remains as wide as ever.
These cases, important as they are for the participants and potentially for other litigants too, remain arguments over whether the FDA dotted the i’s and crossed the t’s correctly; at most, perhaps, over whether the t’s should have been crossed at all. They’re not settling the question of which alphabet to use.

That charity, ASH New Zealand, has been campaigning since the early 1980s against what it calls “the toll of smoked tobacco”. And, unlike the US groups named above, it understands that e-cigarettes are neither tobacco nor smoked.
Intended and unintended consequences
In its submission to the New Zealand Health Select Committee on the pending Smokefree Environments and Regulated Products (Smoked Tobacco) Amendment Bill – which it praises as “a world-leading and bold piece of legislation” – ASH Action for Smokefree 2025 says: “Forty years of tobacco control experience has taught ASH many lessons. We have seen how policies that have reduced smoking rates have often had greatest benefits for the most privileged, and the least deprived, resulting in increases in smoking-related inequity. This outcome has given us cause to reflect on the intended and unintended consequences of our 40-year journey and consider how to implement the proposed bold policies in a fair and empathetic way.”
And it is in this enlightened mood that it tackles the vexed issue of flavours: “There is good evidence that use of fruit and other sweet flavoured e-liquids is positively related to smokers’ transition away from cigarettes. International evidence from four countries concluded those using sweet flavours were 1.6 times more likely to stay smokefree, whereas menthol flavour users were less likely to stay smokefree. We consider that the current restrictions to tobacco, mint and menthol flavour vapes in general stores is counterproductive and in opposition to the evidence. Therefore undermining quit smoking attempts. Allowing two popular fruit flavours more accurately reflects the types of product that ex-smokers use to remain smokefree.”
But before you get the idea that ASH NZ is recommending any kind of free-for-all, it goes on: “The desired outcome is that general retailers (such as dairies and convenience stores) can provide former smokers with more controlled tamper-proof closed pod vaping flavours they enjoy and keep them off smoking whilst avoiding the rise in micro-vape stores that sell a range of products but without the depth of support that a dedicated specialist store offers. Likewise, it also ensures better controls over visibility and access to vaping products for young people.”
It may come as no great surprise to fair-minded observers of global politics to find a more balanced, more thoughtful, less strident approach being expressed in New Zealand than among apparently similar groups in the US. But there, ladies and gentlemen, is another piece of evidence.

The new research adds to a growing body of evidence indicating that banning the sales of safer alternatives drives consumers away from the safer alternatives and back to smoking.
Using state-level cigarette sales data, the researchers found that Massachusetts, which enacted a full ban on nicotine vapes, had 7.5% higher than-expected per capita cigarette sales.
Similarly, sales data released by Piper Jaffray compared the four weeks ending October 20th 2019, to the four weeks prior to the ban, and then compared the figures to the sales data of the same period last year. The analysis revealed that as predicted, ex-smokers in Massachusetts who had switched to vaping in order to curb their habit, returned to smoking.
The decline in cigarette sales’ rates lowered
In a post on his blog page discussing these figures, public health expert Dr. Michael Siegel, pointed out that on a national scale there was only a minimal difference in cigarette sales between these two time periods from 2018 to 2019, and that however this difference was more significant in Massachusetts.
“Nationally, there was very little difference in the rate of decline in cigarette sales between these two time periods from 2018 to 2019. The rate of decline decelerated by 0.3 percentage points (from -7.8% to -7.5%). However, in Massachusetts, the rate of decline decelerated by a massive 5.7 percentage points (from -9.8% to -4.1%),” said Siegel.
“Another way of expressing this is that in September 2019, national cigarette sales were 92.5% of what they were in September 2018, and in October 2019, they were 92.2% of what they were in October, 2018. Thus, there was little change in the rate of decline,” he explained about the national figures.
However, he pointed out, the data specific to Massachusetts tells a different story. “While cigarette sales in September 2019 were 90.2% of what they were in September 2018, in October 2019, they were 95.9% of what they were in October 2018, a substantial lowering of the rate of decline in cigarette sales.”

As to which one to choose between XROS 3 and XROS 3 Mini, the author personally recommends the Mini edition. It works perfect with my nicotine juice, with a smaller size and anti-slip shining surface, though without an air adjustment slider. The strawberries tasted lovely and fresh and the milkshake was like a super thick, mega creamy shake from your favourite ice cream spot.
I highly recommend this bar to anyone who likes a nice, sweet dessert vape or those fruit lovers who are on the hunt for something a little different.
Lemon Lime
Lemon Lime is a citrus number that offers a great contrast to the previous bar…not to mention that it’s real triumph of flavour (in my humble opinion anyway).
Of course the name doesn’t leave much to the imagination, so I’m sure you know what to expect from this one, but it is extremely well done.
The lemon and lime flavours tasted very authentic and were a match made in heaven.
The liquid was sharp and sour with some subtle sweeter notes that kept it from being too mouth-puckering.
This flavour was really smooth and easy to vape for extended periods of time, so keep an eye out for this one if you like your citrus.
Blueberry Raspberry
It’s fair to say that blueberry raspberry flavours are the kings of the disposable market, with many companies boasting their own interpretation…but VOOPOO’s is definitely a standout offering.
This flavour hit all the beats you’d expect, blending sweet blueberries with fresh, tart raspberries.
The contrast of sweet and sour was wonderful and made this yet another VOOPOO flavour that’s super easy to vape.
While there are similar flavours on the market, this is one of the best versions I’ve tried and I urge you to give it a go.
Watermelon Strawberry
This was yet another classic fruit combo and another fantastic example of how to do things correctly!
So many times I’ve used a strawberry-based flavour and been disappointed by the synthetic taste and the same can be said for watermelon liquids as well.
Both of the fruits here tasted vibrant and juicy, with neither flavour overpowering the other instead working together to create a harmonious fruity burst.
I think I saved the best until last here as this bar absolutely blew me away in terms of flavour.

It was the previous, more leftist government which had backed a plan earlier in the year to restrict flavours in nicotine products, but that proposal was rejected by the parliament (although other, less contentious restrictions were approved) and the new administration looks unlikely to resuscitate it or similar ideas.
Novel nicotine products, and tobacco control generally, are rarely to the forefront in elections: not least because there is no real argument about the desirability of reducing smoking, and because relatively few citizens are affected by any measures that might be adopted (or not). But for those in the industry, and for those who use products such as e-cigarettes, they can make a big difference – and nowhere more than in Europe, it seems.

New parties with very different views
In Italy, Spain, and Finland, for example, the next elections “are likely to bring new parties into government with very different views towards tobacco and nicotine product policy”. Indeed, the outcome of Italy’s – due in less than a fortnight – may, if the right wing prevails as expected, be just as welcome as Sweden’s to businesses facing an increase in excise duties.
Of course, this is not the only part of the world where elections matter; the Policy Radar also identifies Canada, the Philippines and the US as races to watch. And, as we reported recently, the possible announcement next month of an early election in Malaysia might put a question mark over the future of that country’s Generational End Game Bill, which would cut off the sale of tobacco products to anyone born after 2007.
But still, it is Europe, with its wide gamut of (current) policy positions, from prohibitionist Norway to pro-harm-reduction Britain, that most vividly illustrates how big-picture politics can and does make a difference – how elections that aren’t “about” vaping or nicotine at all can nevertheless have such an impact on the climate for nicotine alternatives.

If you assumed it was, that is probably more than anything an indication of the current nature of the US e-cigarette market and the regulatory noise that surrounds it. At least the market in disposables, which is what’s under consideration here.
According to the researchers’ report, published last week in the journal BMC Public Health, although the disposables market has expanded rapidly – reaching almost a third of all US vapers and close to 45% of the country’s total e-cigarette market, ECigIntelligence data suggests – vaping surveys have so far concentrated mostly on e-liquids intended for refillable e-cigs. This one turns the spotlight on the accuracy of nicotine labelling on closed-system products.
And what the team found was that what you see (on the label) isn’t always what you get. In fact, if their sample is truly representative and their testing and statistical methods fair and accurate, it never is.
But before we get to those findings (which some readers may find disturbing), it’s worth pausing a moment to consider what the scientists, led by Scott Appleton of Appleton Regulatory Science Services in Chesterfield, Virginia, took as givens right from the start. In their own words: “Electronic Nicotine Delivery Systems (ENDS) have significant potential to reduce the harm associated with smoking combustible tobacco cigarettes.
“A 2018 report from the National Academies of Sciences, Engineering and Medicine (NASEM) concluded that e-cigarettes are far less harmful and have less dependence potential compared to tobacco burning cigarettes. The report also concluded that frequent use of e-cigarettes is associated with increased likelihood of smoking cessation.”
While that may seem like common sense – a statement of the obvious, even – to the vaping industry and its supporters, it is by no means the view of everyone in the regulatory, anti-tobacco community, either in the US or globally.
How much are you getting?
Less contentious, surely, is that “The full harm reduction potential of ENDS cannot likely be achieved unless the products are labeled properly so that consumers have accurate and non-misleading information about the product and its contents.” And it is a fact that the US Food and Drug Administration (FDA) places a high priority on assuring that consumer product labels are truthful and not false or misleading.
For many vapers, knowing how much nicotine you’re getting – and getting the right amount – will be crucial to the whole process of quitting smoking. While consumer confidence is an obvious requirement for any market to thrive.
All of which explains why it was a good idea to put a range of disposable vapes available online or in convenience stores to the test to see whether the nicotine concentration and total amount of e-liquid stated on the label matched what was actually in the device.
Stig Lush Ice and Stig Mango Bomb came closest, at just 0.69% and 1.16% under the stated concentration. Next best was Bidi Stick Zest, with a concentration 1.94% higher than stated. In a world where a 10% tolerance either way is generally accepted, those figures are pretty good.
At the other end of the scale, though, is the product that had only half the claimed nicotine concentration – and the e-cig that contained only 38% as much e-liquid as it said on the packet. And there were plenty not much better.
Overall, 23 of the 51 tested disposables deviated from the stated nicotine concentration by more than 10%, while 30 of the 39 assessed for e-liquid volume were more than 10% out. By either measure, a majority of tested products fell short of what was claimed.
Just nine out of 51 had a greater than stated nicotine concentration – up to 13.9% over – while the rest claimed a greater concentration than they really had. Almost half the entire sample (24 products) overstated concentration by more than 10%, 14 of them by more than a third, and 16 by more than a quarter.
The big picture
In the volume of e-liquid stakes, seven of 39 had more than stated (from 2.67% to 13.3% more), while the rest fell short by amounts ranging from 1% to 62.1%. One in three were found to contain less than 75% as much liquid as they claimed.
Put the two together and the picture looks even worse. While only one examined product actually stated the total quantity of nicotine it purported to contain, “Measured total nicotine amounts were lower than expected total nicotine amounts for all brands” (my italics).
In the most extreme case, one “extra-extra-large” vape contained less than a third as much nicotine as expected, while 11 of the 39 contained half as much or less. “Label discrepancies,” the researchers say, “may be caused by poor manufacturing quality control, losses during storage, or questionable business practices”.
As they admit: “Because of the large number of e-cigarette brands currently available, the samples selected for this survey may not be representative of the overall market.” And further: “The technology and regulatory oversight of these products is evolving rapidly. Therefore, this survey could be outdated in a relatively short time as manufacturers modify their products to optimize consumer acceptance and meet regulatory compliance.”
What they don’t say, but which might be inferred from the discussion of their methods, is that their own process may not be quite as sharp as quoting percentages down to a decimal point should really require.
Nevertheless, the picture they paint suggests US purchasers of disposable vapes aren’t getting their money’s worth. Not in terms of nicotine, anyway. Which from some folks’ point of view, of course, may not be a bad thing.
Or, as the research team themselves conclude: “This study underscores the need for regulatory enforcement of manufacturing quality control and product labeling practices to optimize the harm reduction potential and consumer experience associated with the use [of] commercial disposable/non-chargeable e-cigarette[s].” That much seems undeniable.

Last year, the coalition government discussed introducing the legislation during its four-year term to allow the controlled distribution of cannabis in licensed outlets, yet Lauterbach did not give a timeline for the plan. Many other countries in Europe have already legalised cannabis for limited medicinal purposes, while other have decriminalised its general use.

Not just say: Well, we tried our best,” said Niklas Kouparanis, chief executive Bloomwell Group, one of Germany’s largest cannabis firms.
The legal status of cannabis “varies wildly across the globe,” and while in some countries it may be subject to strict regulations, in others it is still fully banned. Canada legalized the substance for recreational use in 2018, while Uruguay had already done so five years earlier. It’s a common complaint from both sides of the nicotine wars (or nicotine debate, if you prefer to be unrealistically genteel): the other guys just don’t get it.
Either they are so blinded by their animus toward conventional, combustible tobacco products that they fail to see the huge public health benefit in switching to reduced-risk alternatives; or they have fallen so completely for industry propaganda that they ignore the obvious potential calamity that lies in tolerance, the danger that all the wins of tobacco control over the past decades will be reversed as consumers take up “safer” products which still carry far more risk than abstention.
And the accusation that opponents miss the point, deliberately or otherwise, is surely going to be heard for a long time yet.
But is there any actual connection between people’s knowledge of reduced-risk products and their attitudes toward them? That was one of the questions we set out to answer with our first two surveys of members of the European Parliament (MEPs), conducted in 2020 and 2021, and the results were striking.
They more they know, the less risk they see
In both surveys, there was a clear correlation between higher levels of knowledge about novel nicotine products and lower perceived risk. Though the exact degrees of correlation varied by product category, the overall picture was consistent: those who were aware of and had some knowledge of a given category considered it less risky, compared to smoking combustibles, than those unfamiliar with it.
Of course, MEPs are not exactly average consumers, and of course they only come from certain countries, but it doesn’t seem unreasonable to assume that in a broad-brush way a similar pattern might be seen in the wider population and the wider world. Perhaps more importantly, though, it highlights that – at least in Europe – the outcomes of policymaking may be very closely tied to policymakers’ depth of understanding.
That should be no surprise, for this is a debate (or war) with complex ramifications. Whether the knowledgeable, sympathetic MEPs are actually right is a different matter, and not one that the surveys set out to – or could – establish; it is the disparity that’s significant, one that flags both opportunities and challenges for those on both sides who seek to shape policymakers’ views.
Those views can change, though. And this is also apparent from our two MEP surveys so far.
Have perceptions shifted again?
Notably, between 2020 and 2021, while there was still a correlation between high knowledge and low risk perception, it weakened for all categories other than nicotine pouch.
Could it have shifted further since? We will find out shortly, as we launch the third survey (this time also featuring a new question on attitudes to taxation, in anticipation of debate on an EU tobacco excise directive).
If there’s no change in attitudes at all, that would be a great surprise in itself. Quite possibly, changes will be complex, reflecting varying views on (and knowledge of) the increasingly varied products that make up the novel nicotine market.
And, of course, one of the big things to watch out for when we bring you the results is how strong that knowledge-support correlation remains – as a harm reductionist might put it, how far MEPs are still divided into those who “get it” and those who don’t.
