BAT’s Sales Forecasts Rely on Strong Demand For “New Categories” Products

BAT added that an additional 3.6 million customers used its vaping, tobacco heating and oral nicotine products by September 2021.

The tobacco company said that 2021 has been a “pivotal year” with regards to a high demand for its “new categories” products. Its shares, down 3% this year, rose 1.75% to 2,671 pence in morning trading after it flagged a possible share buyback.

BAT added that an additional 3.6 million customers used its vaping, tobacco heating and oral nicotine products by September 2021, bringing its total non-combustible user base to 17.1 million. “2021 is the pivotal year in our transformation journey,” said CEO Jack Bowles said in a statement.

Speaking during a webinar on Tobacco Harm Reduction, BAT’s competitor Philip Morris International Limited (PMI), urged all current adult cigarette smokers to switch to alternative nicotine products. “Smoking causes serious disease, and the best way to avoid the harms of smoking is never to start, or to quit. For decades, tobacco control has focused on strict fiscal, marketing and other measures to deter initiation and to encourage cessation,” said Andre Catantzopoulos.

“Nicotine, while addictive and not risk-free, is not the primary cause of smoking related diseases. The primary cause is the harmful chemicals released or generated by the burning of tobacco and contained in the smoke,” he added.

The former CEO said that a smoke-free future is attainable, and that PMI needs the cooperation of governments and civil society to reach a consensus that with proper oversight and regulation, alternative nicotine products can be part of an effective tobacco policy. “Thanks to rapid advances in science and technology, and strong PMI commitment, these products are now a reality,” he said. Philip Morris (PM.N) has spent over $8 billion on reduced risk products since it began developing them a decade ago, and approximately 30% of its revenue now comes from such products.

To this effect said the company’s current CEO Jacek Olczak, recently said that the company plans to reach their target of having 50% of their sales from smoke-free products by 2025 through organic revenue growth, rather than mergers and acquisitions.

BAT-PMI lawsuit

In May 2020, tobacco giant British American Tobacco (BAT) sued PMI in the United States and Germany, alleging that the tobacco heating technology used in PMI’s HnB device IQOS, had infringed its patents.In September 2021, the ITC ruled in favour of BAT, saying that PMI and Altria must stop the sale and import of IQOS in the US, following a signature from President Joe Biden.

PMI said it planned to appeal the trade agency’s decision, and an Altria spokesperson said the two companies were working together on contingency plans. “We continue to believe RJR’s patents are invalid and that IQOS does not infringe those patents,” an Altria spokesperson said in a statement to CNBC at the time.However, the stipulated deadline passed without any action by the Biden administration, hence the ban went into effect.

Naturally, Philip Morris is disappointed with the result. “Our contingency plans to return IQOS to the U.S. market are underway,” said the company an emailed statement as quoted by Bloomberg. “The U.S. patent office is also reviewing certain claims of the patents in question with initial rulings expected in 2022, albeit subject to an appeal process.”

Oh Dear ITV – WHO Told You That?

Oh dear what have ITV been up to?

If you are not familiar with ITV – they are one of the main 5 free to air terrestrial TV channels here in the UK.

Like many of the channels they also have their own news pages. The article in question is here – Is vaping seen as safe now a new health report advises it as a way to stop smoking?

The article does seem quite positive towards vaping in places with paragraphs such as…

“The NHS says vaping is significantly less harmful than smoking nicotine because they don’t burn tobacco, and don’t produce tar or carbon monoxide – two of the most damaging elements in tobacco smoke.”

“”At a rough estimate, it is expected to be under 5% of the risks of smoking if vaping continues over the long term,” Prof Peter Hajek, Director of the Health and Lifestyle Research Unit at Queen Mary University of London, told ITV News.”Smokers who switch to vaping avoid almost all health risks associated with smoking. It makes sense to recommend such a switch, especially to smokers who find quitting difficult.””

But sadly it did veer into horses**t territory when it started spouting the “EVALI” myth.

EVALI ( E-cigarette or Vaping produce use Associated Lung Injury) was a lung disease which had an outbreak mainly in the USA and was caused by dodgy THC (Cannabis) cartridges.

Sadly the impact of EVALI was that it made people scared of vaping. This is still the case since 2019.

Anyway the ITV article repeated this crap and even got a quote from the well known anti-vaping organisation WHO (World Health Organisation).

“In recent times e-cigarettes and vaping have been linked to an outbreak of lung injury in the USA,” the WHO states on its website.

“E-cigarette emissions typically contain nicotine and other toxic substances that are harmful to both users, and non-users who are exposed to the aerosols second-hand.””

Again vaping nicotine was not the issue in the EVALI cases – it was people buying and using dodgy Vitamin E Acetate infused cartridges.

Our late lovely Neil H wrote an article about this in 2019 – Vaping is not about to kill you – but black market THC cartridges might.

All I can suggest is that ITV need to have a sit in the corner and have a good word with themselves…

And ignore WHO.

The US FDA Rejects Juul’s PMTAs

Many health and anti-vape groups have been pressuring the FDA to flat out reject any applications by Juul for months. In fact earlier this year, several anti-tobacco groups sent a letter to the FDA urging it to take action on the outstanding PMTAs and encouraging the agency to deny applications for flavoured vaping products.

While entities such as the American Lung Association (ALA) and the Campaign for Tobacco-Free Kids said they are “deeply disappointed” that the FDA was still studying a percentage of the applications, including Juul’s. ECigIntelligence revealed that the Campaign for Tobacco-Free Kids has gone as far as saying that it intends to take the agency to court if it did not “immediately clarify” the timeline and reason for these delays.

“We write to urge the U.S. Food and Drug Administration (FDA) to expedite decisions on the premarket tobacco product applications (PMTAs) still pending before the agency involving the flavored e-cigarette products, including those with menthol flavoring and, based on the best available scientific evidence, deny the pending applications for all non-tobacco flavored e-cigarettes in order to protect the nation’s young people from the health harms of these products,” said the letter, which was signed by the American Academy of Pediatrics, the American Heart Association, and the Campaign for Tobacco-Free Kids among others.

Juul’s smoking cessation potential should not be ignored

The Wall Street Journal has recently reported that the FDA was planning to reject Juul’s PMTAs and pull the brand off the US market. Discussing these reports on Filter, Matt Culley, a content creator on the board of the Smoke Free Alternatives Consumer Advocacy (CASAA) said that the FDA should take account the fact that Juul has helped millions quit smoking.

“The Juul product has helped millions of smokers switch to a reduced risk alternative,” he said. “That alone should be enough for an FDA authorization. That being said, Juul has made some mistakes along the way, and they’re being forced into a group full of small businesses who are on the outside looking in.”

Juul to be pulled out of the US market

Of course, this was not the case! The FDA has just issued a marketing denial order (MDO) to Juul. The decision applies to “all of their products currently marketed in the United States,” forcing the manufacturer to completely exit the US market.

“We recognize these make up a significant part of the available products and many have played a disproportionate role in the rise in youth vaping,” stated FDA Commissioner Robert M. Califf.

In response to the FDA decision, a Juul representative said that the brand intends to fight back. “We respectfully disagree with the FDA’s findings and decision,” said Joe Murillo, Juul Labs’ chief regulatory officer, as quoted by NPR.

“We intend to seek a stay and are exploring all of our options under the FDA’s regulations and the law,” added Murillo “including appealing the decision and engaging with our regulator.”

On the article quoted in the Tweet the role of Pharmacists in this is discussed.

It suggests that Pharmacies selling vapes should offer behavioural support to help service users quit.

The NCSCT courses would be ideal to help get staff clued up to give the most accurate and helpful advice to smokers on what alternatives they have.

I think this is a brilliant idea, if the chemists stocked good quality vape products too they could even make a sale from this.

The local stop smoking services in the UK have had a bashing with COVID and funding cuts, so hopefully with the Khan Tobacco Independent Review they can get a boost.

The aim is for any health professional who comes into contact with a smoker to be able to use the “VBA (Very Brief Advice) on smoking” protocol to get the conversation started. This means that smokers can be given advice on alternative nicotine sources and pointed in the direction of support to help them quit.


If Pharmacists and their staff are also trained for this too – I think it could reach many more people.

There is a lot of negative press about vaping (See my Vape News Sentiment Tracker for instance) and if health professionals can reassure people it is a safer way to quit this can only be a good thing!

Nicopure and Right to be Smokefree coalition denied summary judgement

Case brought by key vaping industry players fails to overturn deeming regulation.

In a setback for an industry fighting for its survival, D.C. District Judge Amy Berman Jackson ruled against the e-liquids manufacture Nicopure Labs LLC and upheld the FDA’s rule regulating vapes as tobacco products last week.

“In the Deeming Rule, the FDA simply announced that electronic cigarettes, or electronic nicotine delivery systems would be subject to the same set of rules and regulations that Congress had already put in place for conventional cigarettes,” she wrote in her opinion.

The judge dismissed plaintiffs request for a summary judgement but, crucially, agreed with plaintiffs that they had standing to challenge the rule and that the case was ripe for adjudication, paving the way for a possible appeal.

“We are still reviewing Judge Jackson’s opinion,” said Gregory Conley, president of the American Vaping Association (a plaintiff in the case). “The legal and legislative processes are both long roads with plenty of bumps along the way. The fight to save vaping is far from over.” Attorney Azim Chowdhury, representing the Right to be Smoke-Free Coalition, said in a tweet that they are considering appeal options.

The case is one of a number of different cases on the deeming rule slated to appear before federal courts. Another case, files by Lost Art vapes in the Federal Court of Los Angeles, is still to be heard. This may have a different outcome according to Counsel for the company, Phil Daman.

“We are hopeful that we will have a more favorable result which is better for the industry, as our case and litigation strategy has some nuances which may prove successful”, said Daman.

“Additionally, I believe it is important to have highly focused legislative outreach during this crucial time for the industry. It is necessary to have significant grassroots supper if we expect to have an impact in convincing legislators and agency officials that vapor products should not be regulated as contemplated by the current deeming regulations.

Keep in mind that the [opinion in the DC case] is only one opinion, from one court, in one jurisdiction- albeit a significant one”.

Indeed, lawyers for the Center for Tobacco Free Kids – a lobby group which opposes vaping and supports the FDA’s deeming rule – appear to be getting nervous that the Trump administration might choose not to mount a vigorous defense of the Obama-era.

The Center had joined six other public health organizations, including the American Academy of Pediatrics and the American Heart Association, to oppose vaping community efforts to overturn the 2016 FDA rule. The organizations believe the Trump administration may side with industry to weaken or rescind the rule. They propose to defend the rule in Court if the administration chooses not to, and have filed a motion with the Court which, if passed, would allow them do do exactly that.

Juul Gets a Temporary Stay, Can Sell Products For Now

A federal court has granted Juul Labs a temporary stay preventing the FDA from enforcing its Marketing Denial Order (MDO) that ordered all Juul products off the market. The court also gave Juul permission to file a motion for an emergency stay that would put the FDA denial on hold while the court hears a full appeal.

The MDO, issued yesterday, is now on hold pending further order of the court, which allows Juul to continue selling products for the time being. The stay was granted by a three-judge panel of the D.C. Circuit Court of Appeals, which will also hear Juul Labs’ petition for review (appeal) of the FDA’s denial order.

The temporary stay is intended to give the court time to study Juul’s request for an emergency stay, said the judges, and is not an indication of how the court will rule on Juul’s motion, which is due by June 27 at noon. The FDA will have until July 7 to respond to Juul’s motion, and Juul will have until July 12 to respond to the FDA.

Juul filed the motion for a temporary stay this morning, according to the Wall Street Journal. The company also petitioned the court to review the FDA’s denial order, which ordered all currently sold Juul products—including the JUUL device and four varieties of refill pod—off the market.

Juul’s court filing called the MDO “extraordinary and unlawful,” and said the company would suffer irreparable harm without a stay from the circuit court.

Juul Labs argued that the FDA decision was “arbitrary and capricious and lacks substantial evidence.” The marketing denial was issued, Juul said, after “immense political pressure from Congress once it became politically convenient to blame [Juul] for youth vaping, even though several of its competitors now have a larger market share and much higher underage-use rates.”

The Juul filing questioned the surprise nature of the FDA order, noting that the agency usually offers manufacturers a transition period. The company also complained that news of the MDO was originally broken through a leak to the Wall Street Journal, rather than direct communication with Juul.

“Regulation through leaks and press releases is no way to handle agency action, much less to order a company to cease essentially all business operations,” the company told the court.
